Our AGM on 3 March 2012 was postponed because there is not enough quorum from registered strata title owners to proceed with. The AGM will be held again on 10 March 2012 at 9.30 am at Multipurpose Hall, Block A. This is the final call to form Management Corporation and any quorum will be accepted to convene the meeting next week.

By now, all registered strata title owners have received their notice and invitation for the AGM this Saturday, 3 March 2012 at 9.30 am. Meeting will be held at our Multipurpose Hall, Block A. Kindly inform our security guards to attend this AGM and register as early as you can. You can call Mr. Latiff at our Management Office for more information using this number 03-7987 7587.

I think we all need to settle maintenance fee and sinking fund money up to February 2012 to attend this AGM. Someone from Faber Union mentioned this to me.  Not to worry, our Management Office will be opened this Saturday to serve you.

Dear Owners of Danau Murni Condominium

The first AGM for Management Corporation of Danau Murni Condominium will be held on Saturday, 3 March 2012 at 9:30 am (letter from Faber Union Sdn Bhd dated 14 February 2012). Just as the management prepares, so must owners prepare for the AGM. Consider the following steps:

  • Watch out for AGM notices posted on the notice board and this website.
  • Read the meeting notice, agenda and any information sent with the meeting notice.
  • Prepare your comments and questions.
  • Get ready to discuss resolutions and vote on resolutions.
  • Make sure that you are current with your service charges and any other money owed to the management.
  • Arrive early for the meeting for registration and plan to stay for the entire meeting so that your vote counts for all resolutions.
  • Consider becoming a council member with a view of helping our community.
  • Elect conscientious and honourable council members. Get to know their experience and background.

The success of a Management Corporation can only come from active participation from its members. Whether one participates in the meetings or volunteers to be a MC member, owners should know that major decisions are made at these meetings and should strive to attend each and every meeting called.  By not attending, decisions can be passed by a small minority that can adversely affect the majority of residents until it is challenged at the next AGM or EGM.

S.41 – Duty of original proprietor to convene first Annual General Meeting (excerpts from Strata Title Act 1985)

(4) The original proprietor shall give a written notice of the first annual general meeting to all parcel proprietors constituting the management corporation not less than fourteen days before the meeting.

(5) The agenda for the first annual general meeting shall include the following matters:

(a) to decide whether to confirm, vary or extend insurances effected by the management corporation;

(b) to decide whether to confirm or vary any amounts determined as contributions to the management fund;

(ba) to determine the portion of contribution to the management fund to be paid into the special account to be maintained under section 46;

(c) to determine the number of members of the council and to elect the council where there are more than three proprietors; and

(d) to decide whether to amend, add to or repeal the by-laws in force immediately before the holding of the meeting.

(e) to present the audited accounts of the management corporation

Tempoh permulaan (initial period) adalah tempoh yang bermula dari tertubuhnya Perbadanan Pengurusan (apabila hakmilik strata didaftarkan) dan berakhir apabila satu per empat daripada unit syer tersebut dipindah milik kepada para pembeli.

Pada peringkat tempoh permulaan ini, tuan punya tanah adalah menjadi ahli Perbadanan Pengurusan yang pertama kerana beliau didaftarkan sebagai pemilik bagi semua petak.

Semasa dalam tempoh permulaan, pemaju dan juga pemilik hendaklah bersama-sama menjalankan tugas menguruskan harta bersama dengan menubuhkan Badan Pengurusan Bersama atau Joint Management Body sebelum Perbadanan Pengurusan atau Management Corporation mengadakan Mesyuarat Agung Tahunan Pertama. Pengurusan harta bersama dalam tempoh ini ialah di bawah kuatkuasa Akta Bangunan dan Harta Bersama (Penyenggaraan dan Pengurusan) 2007 [Akta 663]. Mesyuarat Agung Tahunan Pertama adalah mesyuarat pertama yang wajib diadakan oleh perbadanan pengurusan dalam tempoh satu (1) bulan dari tarikh tamatnya tempoh permulaan. Bagi tujuan ini, adalah penting perbadanan pengurusan memastikan:

•     prosedur mengadakan mesyuarat ini dipatuhi;

•     semua pemilik-pemilik yang layak menghadiri mesyuarat ini;

•     daftarai strata (strata roll) dikemaskini terlebih dahulu; dan

•     Notis disampaikan kepada setiap pemilik-pemilik yang layak (bersama-sama dengan surat iringan yang menyatakan item-item dalam agenda mesyuarat).

Perbadanan Pengurusan atau Management Corporation akan menguruskan harta bersama di bawah kuatkuasa Akta Hakmilik Strata 1985 [Akta 318]

Contoh Harta BersamaTangga, laluan kecemasan, pintu masuk dan pintu keluar, koridor, lobi, lekapan dan pemasangan, lif, pelongsor sampah, tong sampah, kawasan,parit, tangki air, pembetung, paip, wayar, kabel dan saluran yang memberi kemudahan kepada lebih daripada satu petak, bahagian luar semua bahagian bersama bangunan, padang permainan dan kawasan rekreasi, jalan masuk, tempat letak kereta dan kawasan meletakkan kereta, ruang terbuka, kawasan landskap, tembok dan pagar, dan segala kemudahan dan pepasangan lain dan mana-mana bahagian tanah yang digunakan atau boleh digunakan atau dinikmati bersama oleh semua penghuni.


(a)  Pemilik asal menurut kuatkuasa Seksyen 40A Akta A 1290 (Akta Hakmilik Strata) mempunyai kewajipan mandatori untuk memindah milik hakmilik-hakmilik strata yang telah didaftarkan atas namanya itu kepada pembeli-pembeli.

 

(b)   Pemilik asal dan pembeli-pembeli hendaklah menyempurnakan pindah milik hakmilik strata tersebut dalam tempoh dua belas (12) bulan seperti berikut:

(i)           Pemilik asal – 12 bulan bermula dari tarikh notis Borang 5F ditandatangani oleh Pentadbir Tanah dan berakhir pada tarikh notis pemindahan hakmilik strata dikeluarkan oleh pemilik asal kepada pembeli atau dalam apa-apa tempoh lanjutan lain yang diluluskan oleh Pengarah Tanah dan Galian Negeri

(ii)          Pembeli – 12 bulan bermula dari tarikh notis pemindahan hakmilik strata dikeluarkan oleh pemilik asal kepada pembeli dan berakhir pada tarikh penerimaan dan penyaksian pindah milik melalui Borang 14A disempurnakan oleh pemilik atau dalam apa-apa tempoh lanjutan yang diluluskan oleh Pengarah Tanah dan Galian Negeri.

(c)   Kegagalan pemilik asal dan pembeli menyempurnakan pindah milik hakmilik strata dalam tempoh yang ditetapkan itu adalah suatu kesalahan dan apabila disabitkan, boleh dikenakan denda tidak kurang daripada RM1,000.00 dan tidak lebih daripada RM10,000.00 setiap petak.

Semua pemilik berdaftar di Kondominium Danau Murni telah pun menerima surat berdaftar daripada Peguam Norasmadi dan Noraini bertarikh 29 Jun 2009 menasihatkan supaya menyempurnakan dokumen pemindahan hakmilik strata dalam masa 12 bulan daripada tarikh tersebut. Kegagalan berbuat demikian hanya merugikan pembeli sendiri kerana mereka boleh dikenakan denda daripada pentadbir tanah iaitu PTGWPKL dan mereka tidak dapat melibatkan diri dalam Perbadanan Pengurusan nanti.

Today we received 20 new garbage bins from Alam Flora Sdn Bhd. They started on new project to provide new bins for apartments/flats/condos around KL and we are lucky to be the first to get it.

These bins are made in Germany under the name SULO. They should last more than five years if we used it wisely. Please lift the garbage lid before throwing your garbage.

Anyway, thanks again Alam Flora Sdn Bhd. You have save our management fund for new garbage bins.

Danau Murni Joint Management Body already informed Sebiro Security Sdn Bhd that the effective date of using access card is 1 October 2011. Our first complaint is that guards kept on opening the barrier gate without any proper checking. Guards need to screen and register vehicle without sticker and access card before coming into our compound.

Problem coming from the above is unauthorised parking at our main compound. From our observation, guards failed to monitor and clamp these cars left at our main compound. Sometimes, blocking others to drop off or pick up passenger. Therefore, we imposed penalty of RM50.00 for each cars captured on our camera. We have captured eleven cars without any clamping devices.  This amount will be deducted from Sebiro Security payment for January 2012.

We still allow cars to drop off or pick up passenger for genuine reason. But sometimes, these bad apples really does not even care about the law. They continue to park indiscriminately.
